Terms and Conditions of the Lugani.io Affiliate Program

1. Terms that are capitalized in the present Terms and Conditions of the Lugani.io’s Affiliate Program (hereinafter – Terms and Conditions) have the same meaning as the terms used in the TERMS AND CONDITIONS OF LUGANI.IO PLATFORM unless indicated differently in these Terms and Conditions.
2. Any User (hereinafter – User), by sharing the referral link or code (hereinafter – Referral Link) can participate in the Lugani.io Affiliate Program (hereinafter – Affiliate Program).
3. The program is applicable to projects offered on the Lugani.io Platform. Lugani.io is entitled to determine at its sole discretion and at any time the types and amounts of advertised bonuses and / or rewards and its services and / or products to which the Affiliate Program applies.
4. Users are prohibited to use the Referral Link:
4.1. in any way that differs from Lugani.io’ values or in any other way that may qualify as an unfair commercial practice, as determined at Lugani.io’ sole discretion;
4.3. to post, publish or otherwise distribute the Referral Link:
4.3.1. to make any kind of commercial activity or paid promotion including online advertising;
4.3.2. to distribute the Referral Link on websites that provide erotic, indecent or deceptive content;
4.3.3. to distribute or publish the Referral Link on websites that provide gambling or betting services or money-back projects;
4.3.4. to distribute or publish the Referral Link on websites that offer the upload or download of illegal content, such as BitTorrent sites;
4.3.5. to distribute or publish the Referral Link on websites that are including but not limited to coupon sites or review sites;
4.3.6. to write emails, text or message people who Users do not personally know;
4.3.7. to integrate in browser extensions or using an automated system, script, program, dialer, or bot through any channel to distribute or post the Referral Link.
5. Users shall not distribute the Referral Link to and refer to potential users being residents (having domicile) of sanctioned jurisdictions.
6. When using the Referral Link and referring a potential user, the User shall warn the potential user, that:
6.1. before registering on the Platform and starting to back projects, the potential user must make sure whether such service and product is allowed and not restricted on the territory of his/her home country;
6.2. backing opportunities available on the Platform are subject to risks and may lead to losses, as well as should be suitable for the personal circumstances of a potential user.
7. Disqualifications:
7.1. the Users will be immediately disqualified from the Affiliate Program if they refer to themselves, or have violated any provision of the Terms and Conditions. All referrals must be new users to Lugani.io and cannot have an existing User’s Profile;
7.3. Lugani.io may review payment and withdrawal information if it suspects a breach of the Terms and Conditions;
7.4. if the User is found to be in violation of any provision of the Terms and Conditions and/or the TERMS AND CONDITIONS OF LUGANI.IO PLATFORM, Lugani.io is entitled to suspend at any time the payment of any Affiliate Program’ rewards. Lugani.io is entitled also to remove any previously paid rewards and to suspend Users from the Affiliate Program.
8. The User has an obligation to immediately stop participating in the Affiliate Program if requested by Lugani.io for any reason, at Lugani.io’ sole discretion.
11. If the referred party backs a project, in USDT or the USDT equivalent in other currency, of financial instruments specified by Lugani.io and at least USDT 1000.00 (one thousand dollar) within the term set in the Affiliate Program’s page, the referred party qualifies for an one-time bonus (hereinafter – the Affiliate Reward) in the amount of 5% (five percent) from the principal backing, in USDT or the USDT equivalent in other currency, of financial instruments held by the referred party exceeding USDT 1000.00 (one thousand dollar) over the period of first 90 (ninety) days after referred party has successfully registered on the Platform. The Affiliate Reward is paid in USDT, in one installment within the timeframe specified on the Affiliate Program’s page, after the amount of principal backing disclosed in this clause is met and all conditions and preconditions for the Affiliate Reward set in the Terms and Conditions have been fulfilled and neither the User, nor the referred party were disqualified for any reason from the Affiliate Program.
12. The exact amounts of the Affiliate Reward as well as other terms and conditions of the Affiliate Program are listed on the Affiliate Program’s page on the Platform.
13. For the User and/ or the referred party to receive the Affiliate Reward, the following preconditions must be fulfilled:
13.1. the User has the right to participate in the Affiliate Program and neither the User, nor the referred party, has breached the Terms and Conditions;
13.2. the referring User must be registered on Platform and have his/ her identity verified via the Lugani.io provided solution;
13.3 the referred party is at least 18 years old
13.4 the referred party must use the User’s Referral Link when creating the User’s Profile (registering), and have his/ her identity verified via the Lugani.io provided solution;
13.5 when creating the User’s Profile on Platform, the referred party must not have a previously created its profile on Platform under any email address before;
13.6 neither the User, nor the referred party, have violated any of the clauses of the Terms and Conditions and/ or TERMS AND CONDITIONS OF LUGANI.IO PLATFORM.
14. Lugani.io pays to the User and/ or the referred party the Affiliate Reward, if all conditions and preconditions for the Affiliate Reward set in these Terms and Conditions have been fulfilled, within the timeframe specified on the Affiliate Program’s page, after the necessary conditions for receiving the Affiliate Reward are passed by depositing electronic funds equivalent to the Affiliate Reward into the Crypto Account and/ or the referred party. When calculating Affiliate Reward, the Terms and Conditions as well as amounts and other terms of Affiliate Reward being in force as of the referred party’s registration moment, will apply.
15. The Affiliate Reward shall include all applicable taxes for participation in the Referral Program and respective taxes (if applicable) shall be covered by the User and/ or the referred party.
16. The User may refer the referral link to an unlimited number of referred parties and receive the Affiliate Reward for each referred party fulfilling the conditions and preconditions set in these Terms and Conditions.
17. The Affiliate Program cannot be used in conjunction with any other promotion.
18. Legal relations arising from the Affiliate Program shall be governed by the Terms and Conditions that have been published on the Platform at the moment when the referred party created the User’s Profile using/ indicating the User’s Referral Link. All that is not defined by the Terms and Conditions shall be defined according to the TERMS AND CONDITIONS OF LUGANI.IO PLATFORM.
19. Lugani.io shall not be deemed responsible for any misuse of the Referral Link, including but not limited to, technical issues that might cause the Referral Link to not work properly, thus not appearing as used when the referred party is creating the User’s Profile on the Platform.
20. Lugani.io is entitled, at its sole discretion and anytime, to unilaterally:
20.1 suspend, terminate or change the terms and requirements of the Affiliate Program, including amounts and terms of the Affiliate Reward;
20.2 change the Terms and Conditions, with immediate effect and without giving Users any prior notice. New versions of the Terms and Conditions as well as other terms of the Affiliate Program are published on the Platform.
